These Terms of Service and Privacy Policy apply to Seshly, a product of AutoXyrium. By using Seshly, you agree to the terms, eligibility rules, and privacy practices described below.

PART A — TERMS OF SERVICE

1. Eligibility and Age Requirements

  • Seshly is intended for students in secondary school and above.
  • You must be at least 13 years old to create an account.
  • If you are under 16 years old, you may only use Seshly with verifiable parental or legal guardian consent.
  • By using Seshly, you represent and warrant that you meet these eligibility requirements.

2. Account Registration and Security

  • You must create an account to access certain features of the Service.
  • Accounts may be created using a student email address, student number, or other approved identifiers.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are fully responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized access or security breach.

3. Use of the Service

You agree to use Seshly only for lawful and educational purposes. You may not:

  • Upload or share harmful, abusive, sexual, or illegal content
  • Harass, impersonate, or exploit other users
  • Attempt to access accounts, systems, or data without authorization
  • Disrupt or interfere with the Service or its infrastructure

We reserve the right to investigate and take action against any misuse of the Service.

4. Educational Content, Notes, and User Submissions

Users may post academic questions, notes, messages, and other educational content (“User Content”).

  • You retain ownership of your User Content.
  • By posting content on Seshly, you grant AutoXyrium a non-exclusive, worldwide, royalty-free license to store, display, reproduce, and use the content solely for operating and improving the Service.
  • You are solely responsible for the accuracy and legality of your content.

5. Tutoring Services and Payments

  • Seshly may connect students with tutors.
  • Tutors are independent users, not employees or agents of AutoXyrium.
  • AutoXyrium does not guarantee academic results, performance, or outcomes.
  • Tutors set their own rates. Payments may be facilitated through third-party payment providers.
  • Unless explicitly stated, payments are non-refundable.

6. Intellectual Property

  • All Seshly software, branding, designs, logos, and proprietary technology are owned by AutoXyrium.
  • You may not copy, modify, distribute, or reverse-engineer any part of the Service without written permission.
  • Unauthorized use of our intellectual property is strictly prohibited.

7. Suspension and Termination

  • We may suspend or terminate your account at any time if you violate this Agreement.
  • We may also suspend access to protect users, comply with law, or maintain platform integrity.
  • You may delete your account at any time, subject to applicable data retention laws.

8. Disclaimers

The Service is provided “as is” and “as available.” We do not guarantee uninterrupted, error-free, or secure access. AutoXyrium is not responsible for:

  • User-generated content
  • Tutor conduct or academic outcomes
  • Third-party services or links

9. Limitation of Liability

To the maximum extent permitted by law:

  • AutoXyrium shall not be liable for indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount paid (if any) by you to Seshly

10. Governing Law

This Agreement is governed by the laws of the Republic of South Africa, without regard to conflict-of-law principles.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of Seshly after changes means you accept the updated Agreement.

PART B — PRIVACY POLICY

12. Information We Collect

a. Personal Information

  • Name, email address, student number
  • Age or date of birth (for eligibility verification)

b. Usage Data

  • App interactions, session data, device information
  • Logs, crash reports, and performance metrics

c. Communications

  • Messages, support requests, and in-app interactions

  • Provide and operate the Service
  • Authenticate users and secure accounts
  • Facilitate tutoring and communication
  • Improve features and user experience
  • Comply with legal obligations

14. Data Sharing

We do not sell personal data. We may share information:

  • To comply with legal requirements
  • To protect the rights and safety of users and AutoXyrium

15. Data Security
